This User Agreement (“Agreement”) governs the use of the website near2property.com (“Platform”), owned and operated by Vritika Homes, having its registered office at:

By accessing, browsing, registering, or using the Platform, you (“User”) agree to be legally bound by this Agreement, along with all applicable laws and regulations in India.

  1. ACCEPTANCE OF TERMS

1.1 By using the Platform, you confirm that you have read, understood, and agreed to be bound by this Agreement.
1.2 If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.
1.3 This Agreement constitutes a legally binding contract between the User and Vritika Homes.

  1. SCOPE OF SERVICES

2.1 The Platform is an online real estate marketplace that enables:

  • Listing of residential, commercial, rental, and resale properties
  • Promotion of real estate-related businesses (agents, builders, architects, etc.)
  • Search and discovery of properties in the Tri-City region (Chandigarh, Mohali, Panchkula)

2.2 The Company acts solely as an intermediary technology platform and:

  • Does not own, sell, or lease any property
  • Does not act as a real estate agent/broker unless explicitly stated
  • Does not guarantee transaction completion between Users
  1. USER ELIGIBILITY

3.1 The Platform may only be used by individuals or entities capable of entering into legally binding agreements under Indian law.
3.2 Users must be at least 18 years of age.
3.3 By using the Platform, you represent and warrant that:

  • All information provided is true and accurate
  • You have authority to list properties or services
  1. USER ACCOUNT & REGISTRATION

4.1 Users may be required to create an account to access certain features.
4.2 Users agree to:

  • Provide accurate and complete registration details
  • Maintain confidentiality of login credentials
  • Be solely responsible for all activities under their account

4.3 The Company reserves the right to:

  • Suspend or terminate accounts without notice
  • Refuse registration in case of suspicious or fraudulent activity
  1. USER OBLIGATIONS

Users agree not to:

  • Post false, misleading, or fraudulent listings
  • Violate any applicable laws or regulations
  • Upload harmful, abusive, defamatory, or illegal content
  • Impersonate any person or entity
  • Engage in spam, phishing, or unauthorized advertising

 

  1. LISTING POLICY

6.1 Users posting listings must ensure:

  • Accurate property details including title, pricing, location, and ownership
  • Compliance with RERA and other applicable real estate laws

6.2 Prohibited Listings:

  • Fake or non-existent properties
  • Duplicate or repetitive listings
  • Properties without proper authorization

6.3 The Company reserves the right to:

  • Modify, reject, or remove listings at its sole discretion
  • Verify listings but is not obligated to do so
  1. CONTENT OWNERSHIP & LICENSE

7.1 Users retain ownership of content submitted by them.
7.2 By posting content, you grant Vritika Homes a non-exclusive, royalty-free, worldwide license to:

  • Use, reproduce, modify, publish, and display such content
  • Promote listings across digital platforms

7.3 The Company reserves the right to remove content that violates these Terms.

  1. INTELLECTUAL PROPERTY RIGHTS

8.1 All Platform content including:

  • Logos, trademarks, design, layout
  • Software, text, images

are owned by Vritika Homes and protected under applicable laws.

8.2 Unauthorized use, reproduction, or distribution is strictly prohibited.

  1. PAID SERVICES & BILLING

9.1 The Platform may offer paid services including:

  • Premium listings
  • Featured advertisements
  • Business promotions

9.2 Users agree that:

  • All payments are made voluntarily
  • Pricing may change without prior notice
  • Payments are non-refundable unless specified
  1. DISCLAIMER OF WARRANTIES

10.1 The Platform is provided on an “as-is” and “as-available” basis.
10.2 The Company does not guarantee:

  • Accuracy of listings
  • Availability of properties
  • Reliability of Users or third parties

10.3 Users must independently verify all information before entering into any transaction.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Vritika Homes shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages
  • Property disputes or legal claims between Users
  • Financial losses arising from transactions
  • Fraud, misrepresentation, or misconduct by Users

 

  1. INDEMNITY

You agree to indemnify and hold harmless Vritika Homes, its owners, employees, and affiliates from any claims, damages, or liabilities arising from:

  • Your use of the Platform
  • Violation of this Agreement
  • Infringement of third-party rights
  1. THIRD-PARTY LINKS

13.1 The Platform may contain links to third-party websites.
13.2 The Company does not control or endorse such websites.
13.3 Users access third-party services at their own risk.

  1. DATA PRIVACY

14.1 Use of the Platform is subject to our Privacy Policy.
14.2 Users consent to the collection and use of personal data as outlined therein.

  1. TERMINATION

15.1 The Company reserves the right to:

  • Suspend or terminate access at any time
  • Remove content or listings

15.2 Grounds for termination include:

  • Breach of Terms
  • Fraudulent or illegal activity
  1. FORCE MAJEURE

The Company shall not be liable for failure to perform obligations due to events beyond its control, including:

  • Natural disasters
  • Government actions
  • Technical failures
  1. GOVERNING LAW & JURISDICTION

17.1 This Agreement shall be governed by the laws of India.
17.2 Any disputes shall be subject to the exclusive jurisdiction of courts in Punjab, India.

  1. DISPUTE RESOLUTION

18.1 Parties shall attempt to resolve disputes amicably.
18.2 If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

  1. MODIFICATION OF TERMS

19.1 The Company reserves the right to modify these Terms at any time.
19.2 Continued use of the Platform constitutes acceptance of updated Terms.

  1. SEVERABILITY

If any provision of this Agreement is found invalid, the remaining provisions shall remain enforceable.

  1. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the User and Vritika Homes regarding use of the Platform.
